We are RAESM WELLBEING PRIVATE LIMITED ("Company", "We", "Our", or "Us") and are committed to protecting Your (collectively, "You", "Your" or "Users") privacy. This Privacy Policy ("Policy") explains:

  • what information is collected via Our website/social media (‘Platform(s)’);
  • purposes and methods of use;
  • how and to whom it may be disclosed and
  • how we protect Your information when You access Our Platform and use our products and services (collectively "Products").

From time to time, we may change this Policy to reflect changes to our privacy practices and the terms of service. If we modify this Policy, we will update the “Last Modified Date” and the changes will be effective as of the date we post the amended version of the Policy. For material changes, we may notify You by posting a prominent notice on Our Platform indicating at the top of the Policy when it was most recently updated or by other appropriate means, such as email through the email address you most recently provided to Us. Irrespective of the above, You agree to periodically review the current version of the Policy as posted on the Platform. By accessing and using the Platform, You agree to the terms of this Policy. If You do not agree, please discontinue the use of the Platform.

This Policy applies to information You provide or We collect through Our Platform. We are not responsible for third-party sites or apps that may link to/from our Products; please review their privacy notices before using such third-party sites, links or apps.

This policy must be read in conjunction with Our Terms of Use.

What roles do we play?

We play the role of a Data Fiduciary when We collect and process personal data about You. We play the role of a Data Processor when We collect and process personal data on behalf of another Data Controller. For the purposes of this Policy, the terms “Data Fiduciary” and “Data Processor” shall have the same meaning as provided under the applicable data protection laws.

We commit to protecting Your privacy and hence Our personal data handling practices are continually reviewed to ensure compliance with the applicable privacy laws and regulations.

Information/Data We Collect

We collect the data You provide only to ensure that we can provide You access to our Platform and Products in the best manner possible. By using the Platform You consent to providing Us data in the ways listed below.

Data added by You: We collect the information that You actively input into the Platform:

  • ATOG account data: We collect the data You provide to Us when You create or update Your ATOG Account, or while making purchases from the Platform as a guest. This includes Your name, phone number, email ID, delivery address (which may be Your home or office address) date of birth, unique User ID, password (as applicable). We may require You to share further data on a later date to confirm the veracity of Your information or pursuant to any additional features added to the Platform. We may also require You to share data pertaining to gender, sexual preference and sexual orientation on the Platform to access certain services, provide You with Information and content, or as part of surveys. However, this shall not be mandatory and failure to provide such personal data shall only affect Your ability to access such services, information or content. Any such information provided to Us voluntarily through our Platform, e-mail and other modes of communication to access such services, information or content may be shared/posted by Us on Our Platform anonymously.
  • Financial data: We collect the data You provide to Us when You place an order for Products on Our Platform. This includes credit or debit card details, e-wallet details and banking details.
  • Feedback and other data: We may collect and record: (a) any emails You write to Us; (b) the calls You make to our customer service personnel; (c) any data You submit to Us on social media and other modes of communication and (d) feedback or comments You provide to Us on Our Platform(s).
  • Data You input when You participate in our referral programs or use any discount codes offered by Us;

Data collected from use of Platform. We collect the following data generated owing to and pursuant to Your use of the Platform:

  • Platform usage data: We collect data on Your interaction with Our Platform, i.e., Platform access dates and times, features or pages viewed, crashes and other system activity, type of browser used to access the Platform, and third-party sites or services used before or in the course of interacting with our Platform.
  • Device data: We may collect data about the devices used to access Our Platform, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, serial numbers, browser type, mobile app, file names and types, and plugins.
  • Purchase data: We collect and retain data regarding the Products You add to Your cart, purchases from the Platform, the amount spent on the Platform, and the payment methods used to make purchases on the Platform.
  • Cookies, log files, web beacons and tracking pixels: We also collect information through the use of “cookies”, “log files”, “web beacons” and “tracking pixels”, and similar technologies to understand how You navigate through the Platform to learn Your preferences. Cookies are small text files that web servers place on Your device; they are designed to store basic information and to help websites recognize Your browser. Log files track actions that occur on Our Platform, and collect data including Your IP address, browser type, internet service provider, referring and exit pages, and date and time stamps. Web beacons, tags and pixels are electronic files used to record information about how You browse the Platform.

Information received from third parties: We may also be working closely with third parties and may receive information about You from such sources. Such data may be shared internally and combined with data collected under Section 4.b (Data collected from use of Platform) above. These websites may not be owned, controlled, or operated by Us. In those cases, We cannot control how information collected by those websites will be used, shared, or secured.

Use of Collected Data

The data we collect from You will be used for the following purposes:

For enabling the Platform: We use the data collected to personalize, maintain and improve Our Platform. This includes using the data to:

  • Create and update Your ATOG Account.
  • Fulfill any orders placed for Products on the Platform (including processing Your payment information, arranging shipping and providing You with invoices and order confirmations, and/or delivering the products to You).
  • Screen Your orders for potential risk or fraud.
  • Perform internal operations necessary to provide You and improve Our Platform, including to troubleshoot software bugs and operational problems, to conduct data analysis, testing, and research and to monitor and analyze usage and activity trends.

For creating detailed user profiles: We may combine and aggregate data collected from You on Our Platform, through e-mail and other mediums in order to create detailed and wholesome user profiles in order to understand You better and attempt to provide You with better Products, Information, content and services. Please note that the use of any information shared by You through one mode of communication/platform will not be limited solely to that mode of communication/platform.

For research and development: We use the data collected for research, product development, piloting new Products, and improving the UI/UX experience – all of which will ultimately improve the Products and how You experience the Platform.

For enabling customer support and communication: We use the information to provide customer support and train Our customer service executives. We may further add features that allow You to call Us (through the Platform or otherwise), similarly, We may also need to contact You through the Platform.

For marketing and outreach: We use the data we collect to market Our Products. This includes sharing Your feedback, ratings and screen names for purely promotional and marketing purposes. Such promotion and marketing may be done via hoardings, banners, pamphlets etc.

For fraud detection and preventing misuse: We use the data We collect to detect fraudulent usage of the Platform and/or misuse of any of the features of the Platform.

For legal compliance and requirements: We use the data We collect to address claims or disputes relating to use of Our Platform, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and official inquiries and subject to applicable laws, when we believe, at our sole discretion that disclosure is necessary to protect our rights; and

When we believe it to be necessary, at our sole discretion, to protect someone from injury.

Sharing of Data

We do not share any personal data about You with any third parties unless necessary to enable the use of Our Platform, to provide Products to You or to comply with applicable laws. We may enter into agreements or arrangements to enable the use of Our Platform and to provide Products to You. We have detailed the manner in which we share the collected data below:

Service Providers: We work with third party vendors and service providers to execute various functionalities of the Platform, including but not limited to entities such as Shopify for e-commerce facilitation, and we may share Your information with such service providers to help Us provide You with our Products, information and other services on the Platform.

Business Partners: We may share Your data for marketing and outreach of Our Products in accordance with the business partners’ policies.

Corporate Affiliates: We may share Your data within Our business group for legitimate purposes.

Change in Control: While negotiating or in relation to a change of corporate control such as a restructuring, merger or sale of our assets, We may have to disclose Our databases and information We have stored in the course of Our operations.

Law Enforcement: If any governmental authority or law enforcement officers request or require any information and We think disclosure is required or appropriate in order to comply with laws, regulations, or a legal process, then We may disclose the information we collect.

We do not share sensitive personal information without Your consent or use it to infer characteristics about You.

Your Rights

  • Right to rectification: In the event that any personal data provided by You is inaccurate, incomplete or outdated, then You shall have the right to provide Us with the accurate, complete and up to date data and have Us rectify such data at Our end immediately. We urge You to ensure that You always provide Us with accurate and correct information to ensure that Your use of Our Platform is uninterrupted.
  • Right to Erasure: You have the right to demand Us to erase Your personal data and We will do so without undue delay, provided that the data is no longer required by Us and there is no legal requirement to retain the data. Once You raise a request for erasure of Your personal data, We will review and process Your request in accordance with applicable laws and regulations. Upon Your request, we will take steps to permanently and irrevocably anonymize Your data, ensuring that it can no longer be associated with You. Please note that in some cases, we may be required to retain certain information to comply with legal obligations and certain data may be exempt from Your request if its retention is necessary for legitimate business purposes, such as resolving disputes, enforcing our terms and conditions, or protecting against fraudulent activities.
  • Right to Access: You can seek a summary of Your data that we are processing. You may also ask Us for a brief summary of Our processing activities.
  • Right to withdraw consent: You may write to Us to withdraw Your consent to any specific data processing. However, please note that, You may not be able to access certain parts of the Platform on the Platform if You withdraw Your consent. Do note that despite Your withdrawal request, we may continue to retain and store Your data as provided in Section 10 (Data Retention) below.
  • Right to opt-out: You may opt out of receiving promotional and marketing emails from Us by writing to Us. You may also opt out of receiving emails and other messages from Us by following the unsubscribe instructions in those messages. Please note that opting out of receiving push notifications may impact Your use of the Platform.

If You wish to remove all Your contact information from Our systems and close all accounts, You may do so by emailing Us and. We will process Your request in accordance with applicable laws and regulations.

However, even if You opt out of receiving Our promotional and marketing e-mails, We will still send You transactional messages through e-mails about Your purchases.

Consent

By using the Platform, creating an account, or purchasing Products, You give Your consent to the collection, use, storage, and sharing of personal data as described in this Policy and the Terms; If any part of this policy is unacceptable to You, or if You later withdraw consent, please email Us at support_atog@atog.in; however, if the permissions required to operate the Platform or fulfill orders are withdrawn- access to the Platform, Products, or related services may need to be suspended or discontinued.

Data Retention

We retain the data and content You provide while You use our Platform, and for a reasonable period afterward, in accordance with applicable laws and regulations. We will not retain Your data, including personally identifiable information, financial and payment details, authentication information, and device location data, once You stop using Our services, unless required by applicable law or otherwise consented by You. We may retain anonymized or aggregated data for statistical or analytical purposes, subject to legal limitations. We retain Your data to:

  • Provide, improve and personalize Our Platform;
  • Contact You about your ATOG Account;
  • Give customer service, personalise Our marketing communications; and
  • Prevent, detect, mitigate, and investigate fraudulent or illegal activities.

We do not retain Your personal data for longer than required for the purpose for which the information may be lawfully used.

Data Security and disposal

We maintain industry-standard security measures, including policies, rules, and technical safeguards, to protect Your personal information from unauthorized access, use, disclosure, alteration, destruction, or loss. The transfer of personal data between Your end device and Us is generally carried out in an encrypted form (TLS encryption). If You communicate with Us by e-mail, access to the same by third parties cannot be ruled out. However, remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and We cannot guarantee its absolute security.

Cross-Border Data Transfers

  • The data We hold about You may be transferred to other countries outside Your residential country for any of the purposes described in this Policy. You understand and accept that these countries may have differing laws relating to the degree of confidentiality afforded to the information it holds and that such information can become subject to the laws and disclosure requirements of such countries, including disclosure to governmental bodies, regulatory agencies and private persons, as a result of applicable governmental or regulatory inquiry, court order or other similar process. In addition, a number of countries have agreements with other countries providing for exchange of information for law enforcement, tax and other purposes.
  • If We transfer Your personal data to third parties for purposes stated in this Policy, We will use best endeavors to put in place appropriate controls and safeguards to ensure that Your personal data is kept accurate, adequately protected, and processed only for specified and reasonable purposes in a manner that is fair, transparent and has a lawful basis, and is stored for no longer than is absolutely necessary.

Children's Data

Our services are for users aged 21 years and above. If You do not fulfil said condition, You should not access our Platform and You should not make any purchase, register, or submit any personal data to Us. We do not knowingly collect data from individuals below the said age and We shall not be responsible for any such information collected by Us. Parents/Guardians may contact Us to request deletion of information provided by children.
